Tericipe

Tericipe Terms of Service

Last updated: October 22, 2026

1. Acceptance of these terms

These Terms of Service ("Terms") are a legal agreement between you and Hess WebTech, LLC ("Hess WebTech," "we," "us," or "our") governing your use of the Tericipe mobile application (the "App"). By creating an account or otherwise using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

PLEASE READ THESE TERMS CAREFULLY. Section 14 contains a binding individual arbitration provision and a class action waiver that affect how disputes between you and Hess WebTech are resolved. They require most disputes to be resolved by arbitration on an individual basis rather than in court, and waive your right to a jury trial and to participate in a class action. You have the right to opt out of arbitration within 30 days, as described in Section 14.

2. Description of the service

Tericipe lets you organize recipes into collections, capture physical recipes using your device's camera and on-device text recognition ("Scan"), follow recipes with a step-by-step cooking mode, and share recipes with others via a link. Some features require an internet connection (account sign-in, sharing, and reading handwriting); scanning itself reads text on your device, and your saved recipes remain viewable using a locally cached copy when you're briefly offline.

The core of the App is free to use. Some optional features are grouped into a one-time purchase called Tericipe Pro — currently, backing up your recipe and profile photos to your account so they appear on your other devices, printing a recipe or saving it as a PDF, and reading handwritten recipes (up to 150 reads a month). Section 15 covers purchases.

3. Eligibility

You must be at least 13 years old to use Tericipe. By using the App, you represent that you meet this age requirement. If we learn that an account belongs to someone under 13, we may suspend or terminate it.

4. Your account

To use most features of the App, you must create an account with a name, email address, and password. You agree to:

You're responsible for all activity that occurs under your account. We use Firebase Authentication to manage sign-in; we do not have access to your plaintext password.

5. Your content

Ownership. You retain all rights to the recipes, descriptions, photos, and other content you create, upload, or scan into the App ("Your Content"). We don't claim ownership over it.

License to us. By using the App, you grant Hess WebTech a limited, non-exclusive, royalty-free license to store, process, and display Your Content solely as necessary to operate and provide the App to you (for example, syncing it to your account and rendering it on your screen). This license ends when you delete the content or your account, except for residual copies retained briefly in backups or caches as described in our Privacy Policy.

Sharing. If you use the Share feature to generate a link for a recipe, you're representing that you have the right to share that content, and you understand that the recipe is published to a public web page and that anyone with the link can view it without signing in (see the Privacy Policy's Section 5 for exactly what the public copy contains and how to have it removed).

Your responsibility for content accuracy. You are solely responsible for the accuracy of recipes you create, scan, or save, including ingredient lists, quantities, cooking times, temperatures, and any allergen or dietary information. The App's recipe-scanning feature uses automated text recognition, which can misread text, omit words, or misinterpret quantities or ingredients. This includes handwriting reading, which uses an AI model and can make mistakes that look plausible, such as a wrong number, unit, time, or temperature; the App highlights the lines containing quantities, units, times, and temperatures that it recognizes so you can check them against the card, but you should check the whole recipe yourself. Always review a scanned recipe carefully — including checking flagged or uncertain items — before relying on it to cook or serve food, particularly around food safety, allergens, and ingredient substitutions. Tericipe does not verify, edit, or guarantee the accuracy, safety, or nutritional content of any recipe, whether scanned, entered manually, or shared with you by another user.

Respecting others' intellectual property. When you create, scan, or share content through the App, you represent that you have the right to do so — for example, that a recipe you scan from a cookbook, blog, or recipe card is either your own original content or content you have permission to reproduce and share. A plain list of ingredients and the functional steps to prepare a dish are generally not protected by copyright, but the specific expression of a recipe — descriptive text, headnotes, personal stories, or photos accompanying it — can be. You agree not to use the Share feature to publish content that infringes another person's copyright or other intellectual property rights.

Your representations and warranties. Each time you create, upload, scan, save, or share content through the App, you represent and warrant that: (a) you own or control all rights in and to Your Content and have all rights necessary to grant the license in these Terms and to create, store, and share Your Content through the App; (b) Your Content, and our use of it as permitted by these Terms, does not and will not infringe or misappropriate any copyright, trademark, trade secret, patent, or other intellectual property right of any person or entity, and does not and will not violate any right of publicity or privacy; (c) Your Content does not and will not violate any applicable federal, state, local, or international law or regulation, and does not contain material that is unlawful, defamatory, or otherwise in violation of these Terms or the rights of any third party; and (d) you are solely responsible for Your Content, including its legality, reliability, and accuracy. We are not obligated to monitor or review Your Content, but we may do so.

Copyright infringement notices (DMCA). Hess WebTech has designated an agent to receive notifications of claimed copyright infringement under the Digital Millennium Copyright Act, 17 U.S.C. §512, and has registered that agent with the U.S. Copyright Office. If you believe content shared through the App (for example, through a public share link) infringes your copyright, send a written notice to our designated agent that includes:

Designated agent:

DMCA Agent

Hess WebTech, LLC

237608 Woodlot Road

Aniwa, WI 54408

Phone: (715) 297-4734

Email: info@hesswebtech.com

Notice and takedown. Upon receiving a notice that substantially complies with the requirements above, we will respond expeditiously to remove or disable access to the reported material (including retracting a share link) and will take reasonable steps to notify the user who shared it that the material has been removed or disabled.

Repeat infringer policy. We have adopted and will reasonably implement a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers of others' copyrights or other intellectual property rights. We may also suspend or terminate an account for a single instance of infringement where we consider it warranted, and we accommodate and do not interfere with standard technical measures used by copyright owners to identify or protect their works.

Counter-notification. If you are a user whose content was removed or disabled and you believe the removal was the result of mistake or misidentification, you may submit a written counter-notification to our designated agent at the address above. To be effective under 17 U.S.C. §512(g)(3), your counter-notification must include:

Upon receiving a valid counter-notification, we will promptly provide the person who submitted the original notice with a copy of the counter-notification and inform them that we will replace the removed material or cease disabling access to it in 10 business days. We will restore the material not less than 10 nor more than 14 business days after receiving the counter-notification, unless our designated agent first receives notice from the original complainant that they have filed a court action seeking to restrain you from engaging in infringing activity relating to the material. Please be aware that under 17 U.S.C. §512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages.

6. Acceptable use

You agree not to:

We may suspend or terminate accounts that violate this section.

7. Third-party services

The App relies on third-party services to operate, including Firebase (Google) for authentication, data storage, cloud photo storage for Tericipe Pro accounts, and the hosting of shared-recipe web pages; Google Play Billing for processing purchases; Google ML Kit for on-device text recognition; and Google Cloud Vertex AI (Google's Gemini model) for reading handwriting when a Tericipe Pro user asks for it. Your use of the App is also subject to the applicable terms and policies of these providers to the extent they apply to you. We are not responsible for outages or issues caused by these third-party services that are outside our control.

8. Disclaimers

THE APP AND ALL CONTENT (INCLUDING ANY SCANNED OR USER-SUBMITTED RECIPES) ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT SCANNED OR SHARED RECIPE CONTENT WILL BE ACCURATE, COMPLETE, OR SAFE TO PREPARE OR CONSUME. YOU ASSUME ALL RISK ASSOCIATED WITH PREPARING OR CONSUMING FOOD BASED ON RECIPES STORED, SCANNED, OR VIEWED IN THE APP.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HESS WEBTECH AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, INCLUDING ANY ILLNESS, INJURY, OR OTHER HARM RESULTING FROM PREPARING OR CONSUMING FOOD BASED ON APP CONTENT. TO THE EXTENT SUCH LIABILITY CANNOT BE FULLY DISCLAIMED, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) $50 USD.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

10. Indemnification

You agree to defend, indemnify, and hold harmless Hess WebTech and its affiliates, licensors, and service providers, and each of their respective owners, officers, directors, employees, contractors, and agents (the "Indemnified Parties"), from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) Your Content, including any claim that Your Content, or our use of it as permitted by these Terms, infringes or misappropriates the copyright, trademark, trade secret, patent, or other intellectual property rights of, or violates the privacy, publicity, or other rights of, any third party; (b) your use of the App; or (c) your violation of these Terms or of any applicable law or third-party right. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you agree to cooperate with us in asserting any available defenses. You will not settle any claim in a manner that imposes any obligation or liability on, or requires any admission by, any Indemnified Party without our prior written consent. This indemnification obligation does not apply to the extent a claim arises from an Indemnified Party's own gross negligence or willful misconduct, and it survives termination of these Terms and your account.

11. Intellectual property

The App itself — including its design, branding, logo, and underlying code — is owned by Hess WebTech and protected by intellectual property laws. These Terms don't grant you any rights to our trademarks, logo, or brand assets except as necessary to use the App as intended.

12. Termination

You may stop using the App and delete your account and all its data at any time from Profile → Delete account (or by contacting info@hesswebtech.com). Deleting your Tericipe account does not cancel or refund a Tericipe Pro purchase, which belongs to your Google Play account; you can restore it to a new Tericipe account on the same Google Play account (see Section 15). We may suspend or terminate your access to the App if you violate these Terms, or at our discretion with reasonable notice where practical. Upon termination, your right to use the App ends, though certain sections of these Terms (including Sections 5, 8, 9, 10, 13, 14, and 15) survive termination.

13. Governing law and disputes

These Terms are governed by the laws of the State of Wisconsin, without regard to its conflict-of-laws principles, except that the Federal Arbitration Act governs the interpretation and enforcement of the arbitration agreement in Section 14. Subject to Section 14 (including its arbitration agreement and the carve-outs in it), any dispute arising from these Terms or the App that is not resolved by arbitration will be resolved exclusively in the state or federal courts located in Wisconsin, and you consent to personal jurisdiction there.

14. Dispute resolution and binding arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL.

Informal resolution first. Before starting an arbitration, you and Hess WebTech agree to try to resolve any dispute informally for at least 30 days. To begin, send a written notice of dispute to info@hesswebtech.com describing the dispute and the relief you seek. If the dispute is not resolved within 30 days after the notice is received, either party may start an arbitration.

Agreement to arbitrate. You and Hess WebTech agree that any dispute, claim, or controversy arising out of or relating to these Terms or the App — including their formation, interpretation, breach, termination, validity, or enforceability, and including claims that arose before you accepted these Terms — will be resolved by final and binding individual arbitration, except as expressly provided in this Section 14. This agreement to arbitrate is governed by the Federal Arbitration Act, 9 U.S.C. §§ 1 et seq.

Delegation. The arbitrator has exclusive authority to resolve any dispute relating to the interpretation, applicability, or enforceability of this arbitration agreement, except that a court, and not the arbitrator, will decide any dispute about the scope, validity, or enforceability of the class action waiver below.

Arbitration rules and administrator. The arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect, as modified by these Terms. The AAA's rules are available at www.adr.org. If the AAA is unavailable or unwilling to administer the arbitration consistent with this Section 14, the parties will agree on an alternative administrator or, failing agreement, a court will appoint one.

Seat, venue, and format. The seat of the arbitration is Wisconsin. For any claim of $25,000 or less, you may choose to have the arbitration conducted solely on the basis of documents submitted to the arbitrator, by telephone or videoconference, or — if the arbitrator determines an in-person hearing is appropriate — at a location in the county or equivalent jurisdiction of your residence. For larger claims, the hearing location will be determined under the AAA rules.

Class action waiver. You and Hess WebTech agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding. If a court decides that this class action waiver is unenforceable as to a particular claim or request for relief, then that claim or request will be severed and may be brought only in a court of competent jurisdiction, but the remainder of this arbitration agreement will continue to apply to all other claims.

Small claims carve-out. Notwithstanding the agreement to arbitrate, either party may bring an individual claim in a small claims court of competent jurisdiction if the claim qualifies for and remains in that court.

Injunctive and intellectual property carve-out. Notwithstanding the agreement to arbitrate, either party may bring an action in the state or federal courts located in Wisconsin seeking injunctive or other equitable relief to prevent the actual or threatened infringement, misappropriation, or violation of that party's intellectual property rights or of the security or integrity of the App or its data.

Fees and costs. Payment of all filing, administration, and arbitrator fees will be governed by the AAA Consumer Arbitration Rules. To the extent those rules or applicable law require Hess WebTech to bear such fees, Hess WebTech will pay them. Each party is otherwise responsible for its own attorneys' fees and costs, except that the arbitrator may award attorneys' fees and costs to the prevailing party to the extent authorized by applicable law.

Your right to opt out of arbitration. You may opt out of this arbitration agreement (including the class action waiver) by sending written notice to info@hesswebtech.com within 30 days after you first accept these Terms. Your notice must include your name, the email address associated with your account, and a clear statement that you want to opt out of arbitration. If you opt out, Section 13 (Governing law and disputes) will govern any dispute. Opting out has no effect on any other part of these Terms and will not affect any prior arbitration agreement between you and Hess WebTech.

Survival and severability. This Section 14 survives termination of these Terms and your account. If any part of this Section 14 — other than the class action waiver, which is addressed above — is found to be unenforceable, that part will be severed and the remainder of this Section 14 will continue in effect.

15. Purchases and Tericipe Pro

What it is. Tericipe Pro is a one-time purchase, not a subscription. There is no recurring charge and nothing to cancel. It currently unlocks (1) backing up your recipe and profile photos to your account so they appear on your other devices, (2) printing a single recipe or saving it as a PDF file that you can send anywhere using your device's share sheet, and (3) reading handwritten recipes from a scan photo, which you ask for one photo at a time. We may add further features to Tericipe Pro over time.

Handwriting reading limits. Handwriting reading is not unlimited. Each Tericipe account can complete up to 150 reads a month. A "month" is a calendar month in Coordinated Universal Time (UTC): the allowance resets on the 1st of each month at 00:00 UTC, which the App shows in your local time. A read that is completed counts toward the allowance even if no recipe is found on the photo; a request that is refused, or that fails or times out on our side, is not counted. If you believe a read was counted by mistake, contact info@hesswebtech.com. To protect the service, there are also short-term limits (currently 6 reads a minute and 60 an hour per account), and handwriting reading may be temporarily unavailable when overall demand is high, during maintenance, or if our provider is unavailable. Unused reads do not carry over to the next month. The number of reads the App shows as remaining is an estimate kept on your device; our server's count is the one that applies.

How it's sold. Tericipe Pro is sold through Google Play, which acts as the seller of record and processes your payment. We never receive your payment details (see the Privacy Policy, Section 2). Your purchase is also subject to Google Play's own terms.

Pricing. The price is shown in the App before you buy. We may change the price of Tericipe Pro for future purchasers; a price change never affects a purchase you have already made.

Restoring your purchase. Tericipe Pro is attached to the Google Play account that bought it, not to your Tericipe account. You can restore it after reinstalling the App or on a new device by signing in and choosing to restore purchases.

One Tericipe account at a time. Because the purchase belongs to your Google Play account, you may restore it onto a different Tericipe account — but Tericipe Pro is active on only one Tericipe account at a time. If you restore it onto a second account, the first account returns to the free version. Content that account already created is not deleted; it simply stops receiving Pro features.

Refunds. Refunds are handled by Google Play under Google's refund policies, not by us. If a purchase is refunded, reversed, or charged back, Tericipe Pro access ends once our regular check with Google Play picks up the change. Losing Pro does not delete anything you have already created — recipes, collections, and photos already stored remain yours and remain visible; the App simply stops backing up new photos and no longer offers printing or saving a recipe as a PDF, or reading handwriting.

Availability. We aim to keep Tericipe Pro features working, but we do not guarantee that any particular feature will remain available indefinitely or without interruption; for example, we may pause handwriting reading temporarily to protect the service or control its cost. If we discontinue a Pro feature entirely, we will provide notice as described in Section 16.

16. Changes to these terms

We may update these Terms from time to time, especially as we add new features (subscriptions, advertising, additional data processing, etc.). We'll update the "Last updated" date above and, for material changes, provide additional notice such as an in-app notification before the changes take effect. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
